Assistant Corporation Counsel

The purpose of the Assistant Corporation Counsel-Child Support Attorney is to represent and advise the Child Support Department on legal matters; respond to legal inquiries, rendering legal assistance and opinions; litigating cases; drafting policies, procedures, ordinances, contracts and legal documents; maintain records, files, and preparing reports. 

 

Essential Duties

 

  • Advise and represent the Child Support Department in child support and paternity cases.
  • Appear in court on behalf of the State of Wisconsin for establishment/revision hearings, pro-se motion hearings, contempt hearings, paternity establishment hearings, and warrant hearings.
  • Prepares legal documents in cases involving establishment, revision, and enforcement.
  • Acts to enforce, establish, and revise support orders in divorce, paternity, action to compel, foster care, and interstate cases.
  • Provides guidance to the child support staff as it relates to legal procedures in the establishment and enforcement of child support-related matters in relationship to Federal regulations and State statutes.
  • Consults and collaborates with the Director concerning changes in Federal regulations and State statutes affecting child support policies and their interpretations and implications for the Agency.
  • Reviews legal documents prepared by support staff to ensure accuracy and completeness.
  • Prepares referral documents to the District Attorney’s office to prosecute criminal non-support cases and provides support during criminal prosecutions.
  • Provides information to custodial/non-custodial parents on procedures concerning establishments and enforcement of child support orders.
  • Consults with other legal counsels, out of state child support agencies, and private attorneys regarding child support issues.
  • Maintains current knowledge of the law by continual review and research of evolving case law and changes in State statutes, federal regulations and policies as it relates to child support matters.
  • Advises staff engaged in establishing, revising, and enforcing support orders, and interviewing/providing information to parents.
  • Maintains confidentiality of files and other information received in the course of duty.
  • Prepare and file court documents such as petitions, subpoenas, motions, orders, stipulations, discovery requests, affidavits, and briefs.
  • Assist the Corporation Counsel with formation and review of ordinances, resolutions, contracts, and interpretation of statues, rules, regulations, and duties of County Board and County officials, mental commitment, guardianship, protective placement, child in need of protection and service cases as needed.
  • Other duties as assigned.


 

Required Working Hours

Standard working hours are Monday through Friday, 8:00 am until 4:30 pm.  Please note these hours are subject to change and additional hours may be needed or required.  Compensation for additional hours beyond normal working hours are subject to applicable state and federal regulations.


 

 

Minimum Training and Education

 

Required:    

Juris Doctorate degree from an ABA accredited law school

Admission to the Wisconsin Bar, with current active bar membership

One (1) year government legal experience in a law office setting.

License:

Valid Wisconsin State Motor Vehicle Operator’s License

Preferred:

Two (2) or more years of experience in family law, child support, and/or general civil law.

Other Requirements:

 Must successfully pass IRS and criminal background check.
