Assistant Prosecuting Attorney I
Salary Range: Min $66,177.65 – Mid $82,208.27 per year
JOB DESCRIPTION: The purpose of this position is to review, recommend charges and prosecute cases from assignment to final disposition by trial or guilty plea. Assignments include a high volume of criminal misdemeanor and traffic cases in addition to assigned felonies under the supervision of a felony attorney. This position may be assigned to the criminal, bad check or child support unit. The work is performed under the supervision of an Assistant Prosecuting Attorney III.
- Represents the State in misdemeanor docket, Director of Revenue cases, jury trials, motion and bond hearings, preliminary hearings and guilty pleas.
- Reviews cases to determine trial strategies, subpoena witnesses, and to request additional investigations.
- Negotiates with defense attorneys.
- Interviews witnesses and victims. Meets with witnesses, victims and law enforcement regarding court appearances.
- Discusses plea negotiations with victims.
- Visits crime scenes and examines evidence.
- Handles depositions.
- Researches various points of law, prepares motions, appeals, responses and arguments.
- Prepares legal briefs and memos.
- Prepares and files criminal charges.
- Prepares charged cases for hearings/ bench trials and jury trials.
- Prepares and conducts court dockets.
- Reviews warrant applications for charges. Assists with the preparation and review of search warrants for law enforcement.
- Provides training for law enforcement.
- Attends and participates in continuing education.
- Assists other prosecutors with applicable docket.
- Prepares, files and argues conviction appeals.
- Reviews case law and statute changes.
- Participates in on-call rotation.
- Maintains filing system.
- Performs other duties as assigned.
REQUIREMENTS:
Education
- Juris Doctorate from an accredited law school and Missouri license to practice law.
Certifications
- Missouri Law license
Knowledge, skills and abilities
- One year prosecution experience preferred, or four years general law practice experience preferred.
- Prefer considerable prosecution experience.
Assistant Prosecuting Attorney II
Salary Range: Min $75,533.16 – Mid $97,211.28 per year
JOB DESCRIPTION: The purpose of this position is to prosecute all misdemeanor, traffic and felony crime cases including chronic offenders, homicides, felony narcotics, sexual assault, etc. from assignment to final disposition; and assist the Team Leader with special assignments, supervision of docket, and supervising less experienced attorneys. This position may be assigned to the criminal, bad check or child support unit. The work is performed under the supervision of an Assistant Prosecuting Attorney III.
- Prepares cases in criminal misdemeanor and/or felony cases, through written and oral advocacy, including trials, hearings, motions, post-conviction review proceedings, misdemeanor appeals and Grand Jury proceedings.
- Prepares legal filings including charging instruments, motions, proposed orders and other legal documents.
- Oversees the discovery practice on criminal cases and negotiates dispositions of criminal cases per the direction and policies of the office.
- Reviews warrant applications, directs criminal investigations, seeks search warrants and investigative subpoenas in conjunction with law enforcement officers from various law enforcement agencies.
- Represents the Prosecuting Attorney as directed in public meetings and appearances to provide training, information, presentations and to participate in meetings and initiatives with civic, professional, non-profit and public organizations.
- Ability to maintain and correctly apply current and in-depth knowledge of pertinent criminal law, constitutional law, rules of evidence, and rules of criminal procedure. Maintains in-depth knowledge of pertinent law enforcement practices and techniques.
- Additional duties as assigned.
REQUIREMENTS:
Education

- Five (5) years in the practice of law, of which at least 2 years must be in the full time prosecution or defense of criminal cases in the circuit courts of the State of Missouri located in counties of the First Class or which are Charter counties; or
- Eight (8) years total practice of law.
- Prefer considerable prosecution experience.
Assistant Prosecuting Attorney III
Salary Range: Min $91,395.12 – Mid $117,625.64 per year
JOB DESCRIPTION: The purpose of this position is to prepare and prosecute felony criminal cases under the direction of an Asst. Prosecuting Attorney IV, First Assistant Prosecuting Attorney or elected Prosecuting Attorney. Individuals may supervise a team of attorneys and/ or support staff; prepare and prosecute criminal cases in the criminal, bad check or child support unit.
- Generally assists the elected Prosecuting Attorney as directed in the proper discharge of the duties of his office, per RSMo 56.151, at the pleasure of the elected Prosecuting Attorney.
- Represents the Prosecuting Attorney’s Office and the State of Missouri in felony criminal cases, through written and oral advocacy, including trials, hearings, motions, post-conviction review proceedings, misdemeanor appeals and Grand Jury proceedings.
- Prepares legal filings including charging instruments, motions, proposed orders and other legal documents.
- Oversees the discovery practice on criminal cases and negotiates dispositions of criminal cases per the direction and policies of the elected Prosecutor.
- Reviews warrant applications, directs criminal investigations, seeks search warrants and investigative subpoenas in conjunction with law enforcement officers from various law enforcement agencies.
- Maintains and correctly applies current and in-depth knowledge of pertinent criminal law, constitutional law, rules of evidence, and rules of criminal procedure. Maintains in-depth knowledge of pertinent law enforcement practices and techniques.
- Represents the elected Prosecuting Attorney as directed in public meetings and appearances to provide training, information, presentations and to participate in meetings and initiatives with civic, professional, non-profit and public organizations.
- Under the direction of the elected Prosecuting attorney, may supervise attorney and non-attorney positions within the Prosecuting Attorney’s Office, may be assigned to manage or lead specialized divisions of the office or designated projects as requested.
- Performs other duties as assigned.

- Seven (7) years in the practice of law, of which at least three (3) years must as a St. Charles County Assistant Prosecuting Attorney II; or
- At least seven (7) years total practice of law of which at least five (5) years must be in the full-time prosecution or defense of criminal cases which involve felony or Class A misdemeanors in the circuit courts of the State of Missouri located in counties of the First Class or which are Charter counties.
