Assistant Public Defender
DISTINGUISHING FEATURES OF THE CLASS
Under the general direction of the Public Defender or a higher-ranking Assistant Public Defender, the incumbent represents, without charge or by court order and with the consent of the defendant, individuals charged with crimes as defined by Section 722(a) of the County Law.
The Assistant Public Defender provides legal counsel and representation at every stage of proceedings following arrest, initiates appropriate legal actions to safeguard the rights of the accused, and may prosecute appeals when warranted. Work is performed in accordance with established legal standards and professional ethics.
TYPICAL WORK ACTIVITIES
- Represents and counsels defendants at all stages of criminal proceedings following arrest
- Initiates and participates in legal proceedings necessary to protect the rights of the accused
- Prepares and files motions, briefs, and other legal documents
- Conducts legal research and case analysis
- Represents clients in court, including trials and hearings
- Prepares and prosecutes appeals when appropriate
- Maintains case records and prepares required reports
- Performs related duties as assigned
KNOWLEDGE, SKILLS & ABILITIES
- Strong knowledge of New York State and Federal Criminal Law
- Thorough understanding of criminal court procedures and rules of evidence
- Skill in legal research, writing, and preparation of briefs
- Ability to effectively present and argue cases before a judge or jury
- Strong analytical skills to apply legal principles to complex situations
- Excellent written and verbal communication skills
- Sound professional judgment, integrity, and discretion
- Ability to work effectively with diverse populations with tact and respect
MINIMUM QUALIFICATIONS
- Eligibility for admission to practice as an Attorney and Counselor-at-Law in New York State at the time of application
- Must be admitted to the New York State Bar at the time of appointment
RESIDENCY REQUIREMENT
Pursuant to Local Law 4-25 (effective June 4, 2025), candidates residing in a New York State county contiguous to Chautauqua County are eligible for appointment. However, individuals appointed under this provision shall not be designated or authorized to serve as department head.
