DEPUTY LABOR COMMISSIONERII     (Wage Hearing Deputy)

Job Description and Duties

 

The mission of the California Labor Commissioner's Office is to ensure a just day's pay in every workplace in the State and to promote economic justice through robust enforcement of labor laws. By combating wage theft, protecting workers from retaliation, and educating the public, we put earned wages into workers' pockets and help level the playing field for law-abiding employers. This office is also known as the Division of Labor Standards Enforcement (DLSE).

We enforce the law by setting a standard of fair and expeditious resolution of claims to achieve long-term compliance from the employers of the State of California. By providing education and meaningful enforcement of wage and hour laws, we combat wage theft and ensure that wages earned are put into the pockets of the workers. Under the direction of the Deputy Labor Commissioner III (Senior Deputy) in the Wage Claims Adjudication (WCA) program, the Deputy Labor Commissioner II (DLC II) proactively investigates and adjudicates claims to verify and determine compliance to the extent permitted by law. The DLC II writes decisions or orders based on evidence presented at hearings in order to enforce laws and effectively handles cases in a timely manner under relevant laws and pursuant to Division policies and procedures.

Deputy Labor Commissioner II

This is the advanced journey level. Under direction, incumbents either serve as Hearing Officers or act as lead investigators on the most complex and sensitive cases, which may involve large or multiple entities, represented defendants, numerous witnesses, extensive audits, and novel or intricate legal issues from investigation through final determination.

In addition to performing the duties described at the lower level, incumbents are responsible for issuing decisions that constitute final orders of the Labor Commissioner and are entered as judgments in Superior Court; providing subject matter expertise in specific industries of case types; serve as expert witnesses in administrative, civil, and criminal proceedings; and lead projects to develop new tools and strategies to enhance operational efficiency and program capacity.

Incumbents also mentor and advise lower-level staff; lead teams on smaller projects; develop training manuals and deliver presentations to educate staff and external stakeholders on labor laws, regulations, and departmental procedures; administer hearings, handle appeals, or prosecute cases on behalf of the division, including co- chairing with division attorneys on complex cases involving wage assessments, damages, civil penalties, or benefit claims; and may serve as a Deputy in Charge of an office, as assigned.
